Corporate Terms of Service

These Terms of Service (“Terms”) govern access to and use of Federal Injury Centers corporate systems, patient portals, training platforms, communications, and resources by patients, franchise owners, and their employees.

1. Independent Franchise Relationship

All FIC locations are independently owned and operated franchise businesses. Franchisee employees are not employees of FIC Corporate and are hired, supervised, and paid solely by the franchise owner. Furthermore, patients receiving care at FIC locations are treated by independent medical professionals and franchise owners. FIC Corporate does not provide direct medical care. Nothing in these Terms creates an employment, joint-employer, agency, or direct physician-patient relationship with FIC Corporate.

2. Permitted Use of Corporate Systems

Authorized users may access FIC systems solely for legitimate business or personal healthcare coordination purposes, including:

  • Patient communication, feedback, and appointment management
  • Required franchise staff training
  • Case management coordination
  • Compliance reporting
  • Approved operational and promotional communications (including SMS/text notifications)
  • System operations and support

3. Age Restrictions & Eligibility

By accessing our corporate systems, patient portals, and opting into SMS communications, you represent and warrant that you are at least 18 years of age. Our platforms, communications, and services are strictly directed to and intended for individuals who are 18 and older. We do not knowingly collect information from, allow portal registration for, or market to anyone under the age of 18.

4. User Responsibilities

Users accessing corporate platforms agree to:

  • Provide accurate information
  • Maintain confidentiality and protect sensitive personal, medical, or business information
  • Protect login credentials and system access
  • Follow FIC compliance protocols (for staff)
  • Comply with HIPAA, OWCP requirements, and all applicable laws
  • Immediately report suspected security incidents

5. Prohibited Activities

Users may not:

  • Share login credentials or allow unauthorized access
  • Attempt to access, export, or misuse unauthorized data
  • Upload malware, viruses, or malicious code
  • Misrepresent identity or affiliation
  • Use systems for unlawful, abusive, or fraudulent purposes
  • Circumvent compliance safeguards, audit controls, or security restrictions

Violation may result in immediate suspension or termination of access.

6. Intellectual Property

All FIC materials, including training content, SOPs, branding, forms, and workflows, are the property of Federal Injury Centers and may not be copied, distributed, or used outside the franchise system without written permission.

7. System Availability

FIC Corporate strives to maintain reliable system access but does not guarantee uninterrupted availability. Maintenance, updates, or technical issues may occur.

8. Limitation of Liability

To the fullest extent permitted by law, FIC Corporate is not liable for medical care provided by independent franchisees, employment decisions made by franchisees, franchisee payroll or HR matters, local clinic operations, or indirect, incidental, special, or consequential damages related to system use.

9. Compliance Obligations

Franchisees and their employees remain responsible for compliance with employment laws, wage and hour laws, HIPAA, OWCP requirements, state licensing rules, professional regulations, and all applicable federal and state requirements.

10. Termination of Access

FIC Corporate may suspend or terminate system access if:

  • Compliance violations occur
  • Security risks are identified
  • Franchise status changes
  • Terms are violated by a user or patient

11. Governing Law

These Terms shall be governed by the laws of the state specified in the Franchise Agreement (for franchisees) or the laws of the State of Florida (for general users/patients), unless otherwise required by law.

12. SMS/Text Messaging Terms

By opting in to receive SMS text messages from FIC Corporate, you agree to the following terms:

  • Program Description: FIC Corporate sends text messages to opted-in users for transactional purposes (e.g., appointment reminders, training updates, meeting notifications, company announcements) as well as promotional purposes (e.g., clinic updates, special offers, patient surveys).
  • Cancellation: You can cancel the SMS service at any time. Just text "STOP" to the short code or toll-free number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time.
  • Help: If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at [email protected] or 877-688-0310.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.
  • Message & Data Rates: As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

13. Updates

FIC Corporate may update these Terms periodically. Continued use of corporate systems constitutes acceptance of the updated Terms.
